The Dynamics of Customary Law Recognition in Environmental Dispute Resolution in Indonesia

This study investigates the recognition of customary law in environmental dispute resolution in Indonesia, with a specific focus on the Kasepuhan Ciptagelar community in West Java as an example of local legal pluralism. Amid growing conflicts between indigenous peoples and corporations, tensions arise between customary norms and state law in natural resource management. Using a juridical-normative approach supported by case studies and limited interviews, the research evaluates how far customary law is acknowledged and applied within environmental dispute mechanisms. Although national regulations provide formal recognition of customary law, implementation in West Java remains hindered by weak coordination, overlapping authorities, and limited institutional commitment. The study concludes that effective customary law recognition requires harmonized central–regional policies and an adaptive model grounded in ecological justice and environmental sustainability.
